Как сообщает РБК, о методике глава ГИБДД Михаил Черников подробно рассказал в письме, отправленном на имя первого замминистра МВД России Александра Горового. «Ловить» нарушителей будут камеры «Стрелка-360», на которые будет установлен специальный программный модуль, «заточенный» на поиск автомобилистов, отвлекающихся на телефон во время движения.
В ведомстве отметили, что есть одна проблема: она связана с тем, что система может ошибочно считать телефоном какой-либо иной предмет в руках водителя и, соответственно, выписать некорректный штраф. В итоге это, конечно же, выльется в жалобы автовладельцев на необоснованные санкции.
Этот вопрос предполагается решить количеством снимков: Михаил Черников пояснил, что система в каждом отдельном случае будет делать не менее десяти фотографий высокого качества, чтобы сомнений в факте нарушения не осталось. При этом предполагается, что лиц водителей на снимках видно не будет (их ретушируют).
Начальник ГИБДД также отметил, что новый программный модуль уже установили на восьми средствах автоматической фиксации нарушений ПДД (пока камеры в Москве ловят нарушителей в тестовом режиме). Кстати, этот модуль будет искать не только водителей с гаджетами в руках, но и автомобилистов, решивших не пристёгиваться ремнём безопасности. Штраф «за телефон», как и в случае выявления инспектором, составит 1,5 тыс. рублей, а за отсутствующий ремень – 1 тыс. рублей.
Как сообщает «Российская газета», по мнению юристов, из-за нововведения в дальнейшем могут начаться судебные разбирательства. Дело в том, что, согласно нынешним нормам, для направления постановлений об административных правонарушениях нет юридических оснований, так как в КоАП и ПДД говорится об использовании телефона, который не оборудован техническим устройством, позволяющим вести переговоры без рук, однако любой современный смартфон имеет функцию громкой связи.
