На излёте гарантии: владелец сгоревшей Lada Vesta отсудил у дилера более 1,1 млн рублей

Инцидент произошёл в Оренбургской области, автомобиль был повреждён в результате пожара, возникшего из-за самовозгорания под капотом. К счастью автомобиль находился на гарантии, гарантийный срок есть не только у автомобилей, но и у телефонов и айфонов.

Житель Оренбургской области приобрёл свою Весту у ООО «АвтоТехЦентр «Жигули», официального дилера Lada, в 2016 году. Весной 2019 года, когда автомобиль ещё находился на гарантии (36 месяцев или 100 000 километров пробега), во время ночной стоянки под капотом возник пожар, в результате которого Vesta получила обширные повреждения. Владелец сгоревшей машины захотел вернуть бракованный, по его мнению, автомобиль продавцу и получить обратно уплаченные за него деньги, но получил отказ, после чего обратился с исковым заявлением в Оренбургский районный суд.

В ходе судебного разбирательства была проведена пожарно-техническая экспертиза, она установила, что возгорание в моторном отсеке произошло вследствие короткого замыкания электропроводки, ведущей к блоку ABS, что является технической неисправностью. Истец предоставил в суд документы, свидетельствующие о надлежащем регулярном обслуживании автомобиля у дилера, последнее ТО проводилось за четыре месяца до пожара, в ходе этого обслуживания у Весты не было выявлено каких-либо недостатков.

Судья в итоге встал на сторону владельца машины, расторг сделку купли-продажи и обязал продавца выплатить истцу полную стоимость Весты на момент покупки в размере 564 000 рублей, неустойку в размере 282 000 рублей, штраф за отказ добровольно пойти навстречу потребителю в размере 211 500 рублей, возместить истцу убытки в размере 75 600 рублей и компенсировать ему судебные расходы. В сумме вышло более 1,13 млн рублей. За эти деньги сейчас вполне можно купить новую Весту в максимальной комплектации.

Ответчик попытался обжаловать это решение в Оренбургском областном суде, но судебная коллегия по гражданским делам оставила вердикт районного суда без изменений.

Добавим, что официальный отзывных кампаний в связи с неисправностью ABS на Вестах не проводилось, а на машинах других марок это довольно типичная, хотя и сложно диагностируемая неисправность: летом этого года Hyunda отзывала в мире около полумиллиона старых седанов Elantra (в том числе 47 653 в России) из-за загадочных вспышек в блоках ABS, природу которых производитель так и не смог установить.

В октябре АВТОВАЗ отзывал Весты из-за риска возгорания по другой причине: контакта топливопровода с неправильно проложенным под капотом при сборке жгутом проводов. Этот отзыв затрагивал машины, выпущенные в 2018-2020 годах, то есть оренбургская Веста точно не из этой парии.
